A DUI is a criminal offense, usually a misdemeanor, but if this is your third DUI within 10 years it becomes a felony, or if this is your 4th DUI, it is also considered a felony.   The punishments for a misdemeanor and felony Tampa DUI can be very extreme and very costly to you if you do not have the right attorney by your side.

During this 30 day period, I will review the officer's police report and video (if one was taken).  I will then decide to subpoena the police officers or just make a legal argument with no officers there.  While this is taking place, I will provide you with a temporary driver's license that will be valid for about 42 days.  This new permit is not as good as your regular license and will have restrictions.  When we speak I will explain the restrictions.  If I win your license hearing you will be able to obtain a duplicate driver's license.  If the hearing is lost, you will not be able to drive for a period of time depending on several issues including if you refused the breath test and if you have prior DUI convictions. If the DMV finds that your blood alcohol level was .08 or higher, you will lose your license for 6 months from the date you were arrested. However, you are eligible for business purpose license during those 6 months, but you must serve a 30- day hard time, no driving period from the date your temporary permit expires. Once your 30 day period expires, you can go to the DMV to obtain business purpose license.  Secondly, if the DMV finds that you have refused to give a breath test, you will lose your license for 12 months from the date you were arrested. However, you are eligible for a business purpose license, but you must serve a 90-day hard time, no driving period from the date your temporary permit expires. When your 90 day period expires, you can go to the DMV and obtain a business purpose license.  But remember, you have only 10 days from the date of your arrest to file for  your hearing.  The administrative process stated above has no legal connection to the DUI prosecution.  There are, however, attacks on the entire situation that may apply equally in both instances.  Everything from the legality of the stop, condition of the Intoxilizer  breath testing machine, the field sobriety exercises,  your personal physical condition and unique factors (diabetes, dentures, inner ear infections, prior and current injuries) and much more all play a roll in your defense to the charges as well as the administrative suspension.  Contact an experienced Tampa DUI lawyer who knows how to defend your rights.
